Our typical Bankruptcy clients end up keeping the following “exempt assets”:
  • $21,000 worth of personal property;
  • Up to $300,000 in Homestead Exemption (equity in your home);
  • Up to $4,000 worth of a motor vehicle;
  • Up to $1 million in IRA, 401(k), Keogh, Social Security, Unemployment, Disability, Public Assistance, Worker’s Compensation, or Veteran’s Benefits;
  • Up to $7,500 in payment for personal injury;

Allen A. Kolber has represented homeowner clients in fighting foreclosure, obtaining loan modifications, principal mortgage reduction, short sales and discounted purchases of Mortgages and Notes.
In March 2014, Allen Kolber defeated a $1 million foreclosure lawsuit brought by U.S. Bank against a homeowner client. After trial, Justice Gerald E. Loehr of the Supreme Court, Rockland County, dismissed U.S. Bank’s foreclosure lawsuit and issued a decision that U.S. Bank failed to prove it actually owned the $1 million mortgage it was attempting to foreclose upon.
